Florida Murder Charges Under Florida Statute 782.04

Florida law defines several distinct degrees of murder, each with different elements and penalties. The charge against you matters because the defense strategy depends on it.

First-Degree Murder
Under Florida Statute 782.04(1), first-degree murder includes both premeditated murder and felony murder. Premeditated murder requires proof that the accused planned the killing in advance. Felony murder applies when a death occurs during the commission of an enumerated felony such as robbery, arson, burglary, kidnapping, or sexual battery. In felony murder cases, the prosecution doesn’t need to prove intent to kill. Both are capital felonies punishable by life without parole or death.

Second-Degree Murder
Florida Statute 782.04(2) covers killings that lack premeditation but involve a depraved mind showing utter disregard for human life. This is a first-degree felony carrying up to life in prison.

Third-Degree Murder & Manslaughter
Third-degree murder under Florida Statute 782.04(4) involves an unintentional killing during the commission of a felony other than those enumerated under the first- and second-degree felony murder provisions. Florida is one of only three states with this statute, and it carries up to 15 years as a second-degree felony. Manslaughter under Florida Statute 782.07 is a lesser included offense carrying up to 15 years, or up to 30 years as aggravated manslaughter. When a firearm is discharged and causes death or great bodily harm, the 10-20-Life law under Florida Statute 775.087 can add a mandatory minimum of 25 years to life on top of the underlying conviction.
