Florida Homicide Charges: The Range
Florida codifies homicide offenses primarily in Chapter 782 of the Florida Statutes. The law recognizes several distinct charges, and not every person charged with a killing intended to kill anyone.
- First-degree murder (capital felony): Requires premeditation, or occurs during a qualifying felony under the felony murder rule, or involves a death caused by a controlled substance the defendant unlawfully provided. Life without parole or the death penalty.
- Second-degree murder (first-degree felony): A killing that reflects a depraved mind regardless of human life, without premeditation. Up to life in prison.
- Third-degree murder (second-degree felony): A killing during the commission of a non-enumerated felony. Up to 15 years.
- Manslaughter (second-degree felony): A killing by culpable negligence or without lawful justification that doesn’t meet the definition of murder. Up to 15 years and a $10,000 fine.
- Aggravated manslaughter (first-degree felony): Manslaughter involving a child, elderly person, disabled adult, or on-duty first responder. Up to 30 years.
- Vehicular homicide (second-degree felony, elevated to first-degree if the driver fled): A death caused by reckless operation of a motor vehicle. Failure to stop and render aid increases the charge to a first-degree felony.
Florida abolished parole for nearly all offenses in 1983. A life sentence imposed today means life. There is no statute of limitations on capital or life felonies under Florida Statute 775.15, so early action matters even before charges are filed.
